Deleted data may be permanently removed and cannot always be recovered.

Before running cleaning or optimisation operations, you should create a complete backup of important files.

You are solely responsible for maintaining current backups of your data.

Except where automatic cleaning has been explicitly enabled, the Program requests confirmation before deleting files.

You are responsible for reviewing the files proposed for removal before confirming any operation.

Removing files required by other software may affect the operation of those applications.

9. Updates and Changes to the Program

During your subscription period we may provide updates, patches, security fixes and new versions of the Program.

Updates may be installed automatically to improve functionality, compatibility and security.

We may add, modify or remove features provided that the Program continues to perform substantially as described.

Support for outdated operating systems or hardware configurations may be discontinued where continued support is no longer practical.

Where such changes materially affect consumers, appropriate notice and any applicable remedies will be provided.

10. Disclaimer of Warranties

Subject to applicable consumer protection laws, the Program is provided on an "as is" and "as available" basis.

We do not guarantee uninterrupted operation, complete error-free performance or compatibility with every hardware or software configuration.

Actual optimisation results depend on the condition and configuration of your computer.

Except where prohibited by law, all implied warranties are excluded.

Any information or advice provided by us does not create additional warranties unless expressly stated in this Agreement.

11. Your Statutory Rights as a Consumer

Nothing in this Agreement limits or excludes your statutory consumer rights.

If the Program is faulty, not as described or not fit for purpose, you may be entitled to repair, replacement or an appropriate price reduction under applicable consumer protection legislation.

Where defective software causes damage to your device or digital content due to our failure to exercise reasonable care and skill, you may also have additional legal remedies.

Advice regarding consumer rights can be obtained from the relevant consumer protection authorities in your jurisdiction.

12. Limitation of Liability

Nothing in this Agreement excludes liability that cannot legally be excluded, including liability for death or personal injury caused by negligence, fraud or other liability that cannot lawfully be limited.

You agree to comply with all applicable export control and sanctions laws relating to the Program.

You must not export, transfer or make the Program available where such action would violate applicable laws or regulations.

You confirm that you are not located in, or acting on behalf of, any restricted country or sanctioned person where use of the Program would be prohibited.

17. Governing Law and Jurisdiction

This Agreement is governed by the laws of England and Wales.

If you are a consumer resident in another jurisdiction, you may also benefit from mandatory legal protections available under the laws of your country of residence.

Subject to applicable consumer rights, disputes arising under this Agreement shall be submitted to the courts of England and Wales.

18. Changes to this Agreement

We may update this Agreement from time to time to reflect changes in the law, our services or business practices.

The latest version will always be published on our website together with its effective date.

Where required by law, users will be notified in advance of material changes before they take effect.

Continued use of the Program after the effective date constitutes acceptance of the updated Agreement, except where applicable law requires a different process.

The Program may include, interact with or rely upon third-party software, libraries or online services.

Such third-party components remain subject to their own licence terms and conditions.

If any provision of this Agreement is found to be unlawful, invalid or unenforceable, that provision shall be interpreted to the minimum extent necessary or, where required, severed from this Agreement.

The remaining provisions shall continue in full force and effect.

22. Entire Agreement

This Agreement, together with the Privacy Policy and any documents expressly incorporated by reference, constitutes the entire agreement between you and RAPID-LOGIC LTD regarding the Program.
